5. Advertising and Marketing Standards

All products commercialized through TucoPay must be promoted using lawful, accurate, and transparent advertising practices.

This requirement applies to advertisements, landing pages, websites, sales funnels, email campaigns, social media promotions, and any other marketing channels.

The following practices are prohibited:

TucoPay may request access to advertising materials, sales pages, and marketing funnels as part of its review process.

6. Product Approval and Changes

TucoPay may review products before or after they become available for sale.

Approval of a Vendor account does not constitute automatic approval of every product offered by that Vendor.

TucoPay may require separate approval for individual products, product categories, or material changes to an existing offering.

Vendors must not:

  • Substitute approved products with undisclosed products.
  • Use an approved checkout to process payments for an unrelated or prohibited product.
  • Conceal the destination or purpose of payments.
  • Add prohibited products to previously approved sales funnels.
  • Circumvent restrictions by modifying product names, descriptions, or classifications.
  • Use another Vendor account to evade a suspension or restriction.

  • The frequency of recurring payments.
  • Any trial period and its applicable conditions.
  • The date or conditions under which recurring billing begins.
  • The process for canceling the subscription.

Recurring billing must be supported by the customer's clear and informed consent.

Hidden subscriptions, unauthorized recurring charges, misleading trial offers, and deliberate obstruction of legitimate cancellation requests are prohibited.

TucoPay may require Vendors to modify subscription practices that create excessive disputes, complaints, or compliance risks.

8. Refunds, Disputes, and Consumer Protection

Vendors must comply with TucoPay's Refund Policy and all applicable consumer protection requirements.

Vendors must cooperate with TucoPay in connection with:

  • Customer refund requests.
  • Product delivery issues.
  • Subscription cancellation requests.
  • Payment disputes and chargebacks.
  • Fraud investigations.
  • Consumer complaints.
  • Requests for evidence of product delivery or service fulfillment.

Vendors may not impose contractual terms or operational practices that unlawfully restrict consumers' rights.

Excessive refund rates, chargeback activity, consumer complaints, or suspected deceptive practices may trigger additional review or enforcement action.

9. Monitoring and Compliance

TucoPay may conduct ongoing monitoring of Vendor activities and approved products.

Monitoring may include:

  • Product and website reviews.
  • Review of sales funnels and advertisements.
  • Transaction risk analysis.

TucoPay may use automated systems and manual reviews to identify potential violations of this Policy.

10. Enforcement and Consequences

If TucoPay identifies an actual or reasonably suspected violation of this Policy, we may take proportionate action based on the nature, severity, and urgency of the risk.

Such actions may include:

  1. Requesting additional information or documentation.
  2. Requiring corrections to product descriptions or marketing materials.
  3. Rejecting or removing products.
  4. Temporarily restricting product sales.
  5. Suspending payment processing.
  6. Suspending or terminating the Vendor relationship.
  7. Withholding or delaying amounts payable to the Vendor where authorized by applicable agreements, law, or payment network requirements.
  8. Establishing or adjusting financial reserves where contractually permitted.

Immediate action may be taken where reasonably necessary to prevent fraud, unlawful activity, financial losses, consumer harm, or violations of payment network obligations.

Any financial restrictions, reserves, or termination procedures will be governed by the applicable Vendor agreement and legal requirements.

11. Payment Partner and Regulatory Restrictions

TucoPay works with payment processors, acquiring institutions, financial service providers, and payment networks that maintain their own underwriting and acceptable-use requirements.

The availability of any product or business category may be subject to restrictions imposed by these partners.

TucoPay may reject, suspend, or discontinue support for a product when:

  • An applicable payment partner prohibits the activity.
  • A required approval is denied, withdrawn, or expires.
  • Applicable laws or regulatory requirements change.
  • Payment network rules restrict the relevant transaction type.
  • The activity presents an unacceptable risk to TucoPay or its commercial partners.

Approval by TucoPay does not guarantee approval by any particular payment processor or financial institution.

12. Policy Updates

TucoPay may amend this Policy from time to time to reflect changes in applicable law, payment network requirements, underwriting standards, operational risk, or business practices.

Material changes will be communicated to affected Vendors through appropriate channels, where required by applicable law or the governing agreement.

Updated versions will be published on our website with the applicable revision date.

Continued use of TucoPay's services following the effective date of an updated Policy constitutes acceptance to the extent permitted by applicable law and the governing agreement.

13. Relationship with Other Agreements

This Policy forms part of, and should be read together with, TucoPay's applicable Terms of Service and Vendor agreements.

Compliance with this Policy does not relieve Vendors of their obligations under applicable laws or other contractual requirements.

Where multiple restrictions apply to a product or activity, the more restrictive applicable requirement will govern, subject to mandatory law and the governing agreements.

Nothing in this Policy obligates TucoPay to approve or continue supporting any particular product, service, or Vendor.
